Section 8 Rent Increases

Are Section 8 units covered by Rent Control?
Section 8 units are exempt from Oakland Rent Control but are included in Oakland's Just Cause eviction restrictions and other aspects of Oakland's rent ordinance.

How do Section 8 rent increases work?
Rent increases for Section 8 units are not automatic and must be reviewed and approved by OHA. Rent increases can only be considered after the initial lease term (usually one year). Section 8 rent increases are not a set amount or percentage, they are based on the market rent for the property at the time of the request.

All rent increase requests must be in writing, and if approved by OHA, will go into effect 60 days after they are received. OHA will provide a letter to owners specifying the amount of the new rent and the effective date of increase within 15 business days of receiving a request. This notice will also indicate what the new rent portions will be.

How much security deposit can I collect?
You may collect a market rate security deposit that is within the limits of the law and consistent with what you collect from private market tenants.
