Are Section 8 units covered by Rent Control?
Section 8 units are exempt from Oakland Rent Control but are included in Just Cause eviction restrictions and other aspects of Oakland's rent ordinance.

How do Section 8 rent increases work?
Section 8 rent increases are not a set amount or percentage, they are based on the market rent for the property at the time of the request. The property owner cannot give a rent increase until after the end of the initial lease term (usually one year).

To get a rent increase the property owner must give you proper written notice of the increase according to state law and also give OHA at least 60 days written notice. All Section 8 rent increases must be reviewed and approved by OHA. If the increase is approved OHA will give you at least 30 days written notice before the increase becomes effective. The notice from OHA will also tell you what your new rent portion will be.

Security Deposits
How much security deposit do I have to pay?
You are responsible for paying all of the security deposit for the unit you rent. The amount the owner collects for the deposit must be within the limits of state law and cannot be more than what is charged to private market tenants. State law limits security deposits to no more than twice the rent for an unfurnished unit, and no more than three times the rent for a furnished unit. OHA does not offer security deposit assistance.
