Labor Compliance
Overview
OHA’s Labor Compliance effort ensures that construction laborers are paid prevailing wages as outlined in the Davis-Bacon Wage Rate Act, and associated HUD regulations. In order to assure compliance with the law, OHA undertakes a variety of actions including:
- Visit Construction Sites
- Interview Construction Workers
- Review Certified Payroll Records for Accuracy
- Resolve Payment Discrepancies
Reporting Suspected Wage Violations
If a violation of the Davis-Bacon Wage Rate Act is suspected, a request for an investigation may be made by contacting the OHA Compliance Officer. Upon receipt of a written complaint alleging that a contractor or subcontractor has failed to pay prevailing wages, the OHA Compliance Officer shall do the following:
- Within 15 days, after receiving the written complaint
- Send a written acknowledgment to the complaining party that the complaint has been received, identifying the name, address, and telephone number of the investigator assigned to the complaint.
- Notify the allegedly offending contractor, OHA’s receipt of the written complaint.
- Until the complaint has been resolved:
- Once every 30 days, notify the complaining party in writing about the status of a complaint; and
- At least once every 90 days, notify the complaining party in writing about the status of a complaint that has been resolved by OHA but remains under review or in litigation before another entity.
- When the complaint is resolved:
- Notify the complaining party in writing that the complaint was resolved.
